Terms of Service

Effective: February 16, 2025

Introduction

These Terms of Service ("Terms") govern your use of SigSense ("we," "us," or "our"). By using our service, you agree to these Terms. If you do not agree, please do not use the service.

These Terms apply to all users of SigSense, including customers, companies, and organizations. For information about how we collect and use data, please see our Privacy Policy. For questions or support, please contact us.

The service

SigSense provides an AI-powered answer engine that helps visitors find information on your website. The service includes content indexing, question answering, and conversation management.

We may provide onboarding and setup assistance as part of the service. This assistance is provided to help you get started and may include guidance on configuration and best practices.

Account responsibilities

You are responsible for:

  • Providing accurate and complete information when creating an account or using the service
  • Keeping your access credentials secure and not sharing them with unauthorized parties
  • Ensuring you have the legal right to connect and index any website or content you provide to the service
  • Complying with all applicable laws and regulations when using the service

Acceptable use

You agree not to use the service for any illegal, harmful, or unauthorized purpose. Prohibited uses include:

  • Any illegal activity or violation of applicable laws
  • Abuse, harassment, or distribution of harmful, offensive, or defamatory content
  • Attempts to break, probe, overload, or disrupt the service or its infrastructure
  • Scraping, reverse engineering, or attempting to extract proprietary information from the service
  • Use that violates third-party rights, including intellectual property, privacy, or contractual rights
  • Impersonation or misrepresentation of your identity or affiliation

We reserve the right to suspend or terminate access for violations of these restrictions.

Service limitations and disclaimers

The service is provided "as-is" and "as-available." We do not guarantee:

  • Uninterrupted, error-free, or secure operation of the service
  • That the service will meet your specific requirements or expectations
  • That defects or errors will be corrected within any particular timeframe

AI and assistant outputs

Responses generated by the service may be incomplete or inaccurate. You are responsible for verifying critical information before acting on it. The service uses AI technology that may produce errors, and we do not guarantee the accuracy, completeness, or reliability of any responses.

We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Billing, upgrades, and payments

SigSense upgrades and paid plans are handled manually. If you choose to upgrade, we will confirm pricing and payment terms with you in writing before any charges apply.

Billing is conducted via manual invoice. Payment methods and due dates are agreed as part of the upgrade process. For current pricing information, please see our Pricing page.

Fees are non-refundable unless required by law or otherwise agreed in writing.

Termination

You may stop using the service at any time by discontinuing access or contacting us to request account closure.

We may suspend or terminate your access if:

  • You breach these Terms or engage in prohibited use
  • You fail to pay fees when due
  • We are required to do so by law or legal process
  • We determine termination is necessary to protect our rights or the service

After termination

Upon termination, your access to the service will end. Data retention is governed by our Privacy Policy. The following provisions survive termination: payment obligations, disclaimers, limitation of liability, and any other terms that by their nature should survive.

Limitation of liability

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages.
  • Our total liability for any claims arising out of or related to the service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim, or $100, whichever is greater.
  • We are not responsible for losses resulting from your use of, or inability to use, the service, including loss of data, revenue, or business opportunities.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.

Changes to terms

We may update these Terms from time to time. When we make changes, we will update the effective date at the top of this page. Continued use of the service after changes constitutes acceptance of the updated Terms.

We will notify users of material changes by posting the updated Terms on this page. For significant changes, we may provide additional notice through email or other reasonable means.
